The Case: A Major Automotive Manufacturer Claims Four Competitors Infringed Upon Their Patent

The plaintiff, a major automotive manufacturer, filed patent infringement suits against four notable automotive providers operating under a German multinational manufacturing brand. The suit accused the automakers of stealing its patented “Terrain Response” system, which helps drivers navigate different off-road terrains. The plaintiff lodged the suits against the manufacturers in Delaware federal court and in New Jersey federal court and later in an investigation against all four automakers filed with the U.S. International Trade Commission.

The Ask: An Automotive Manufacturing Expert Who Understands Vehicle Control Systems

Our client approached WIT to provide a highly skilled automotive manufacturing expert to evaluate the defendants’ use of their intellectual property. The case required an expert with extensive experience with vehicle control systems and more specifically, vehicles with multi-input traction control systems.

Why WIT was Best Suited to Meet the Expert Witness Need:

In anticipation of a high demand for experts for lawsuits involving emerging automotive technology, WIT has actively recruited and retained world-class academics, industry executives, and subject-matter experts to support clients in litigation. For this case, WIT was able to recommend an affiliate automotive expert with deep knowledge of the development and application of multi-disciplinary dynamic system modeling, vehicle system dynamics and controls, and electromechanical system modeling and simulation.

Our expert provided insights on how the system’s patent may have been violated. The ITC opened an investigation into the claim of patent infringement, and the dispute concluded after a settlement between the automakers was reached.
